9. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence where the law prohibits such limitation, or fraud.
Subject to the paragraph above, to the maximum extent permitted by law, Intellygent AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption arising from or related to your use of the website.
Our total aggregate liability for all claims arising out of or related to your use of this marketing website at intellygent.ai in any twelve‑month period is limited to the greater of (a) one hundred pounds sterling (£100) and (b) the total fees (if any) you paid to Intellygent AI for access to this website in that period. Most visitors do not pay for browsing; in that case the cap is £100. Separate terms for paid products, trials, or enterprise services may set different financial limits and are not replaced by this section.
10. Indemnity
You will defend and indemnify Intellygent AI and its officers, directors, and employees against third‑party claims, damages, and costs (including reasonable legal fees) arising out of your misuse of the website or breach of these Terms, except to the extent caused by our wilful misconduct.
11. Changes
We may modify these Terms from time to time. We will post the updated version on this page and change the "Last updated" date. If we make material changes, we will take additional steps where required by law. Continued use after the effective date constitutes acceptance of the updated Terms unless applicable law requires otherwise.
12. Governing law and disputes
These Terms, and any dispute arising from your use of this marketing website, are governed by the laws of England and Wales, excluding conflict‑of‑law rules that would apply another country's law to the contract itself. Intellygent Limited is incorporated in the United Kingdom, which supports this choice of law for an English-language site with global visitors.
You and we agree that the courts of England and Wales have non-exclusive jurisdiction for disputes under these Terms, except that if you are a consumer resident elsewhere, you may also have the right to bring claims in your home country under mandatory local law, and we do not limit those rights.
13. General
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
